課程概述

本課程的目的在於引發學生從必較分析的觀點思考全球化對於法治 (rule of law) 在理論與實務的影響。本次上課聚焦在各種有關全球憲政主義 (global constitutionalism) 的學說討論。除第一次上課導論外,課程結構如下:第二次上課以「憲法化」(constitutionalization) 此一全球憲政主義理論的核心概念為分析焦點,第三次至第五次上課將集中討論歐盟作為全球憲政主義理論雛形及其運用所衍生的問題,第六次與第七次上課探討各種不依附政治秩序所提出的全球憲政主義觀點,第八次則反思全球憲政主義思考與內國憲政主義實踐的關係。

必要具備條件:良好程度的英文閱讀能力,具備參與課堂討論的能力與熱忱。

注意事項:
1. 除非事先經過教授同意,否則不開放加簽。想要旁聽的同學請聯絡課程助理。旁聽生需全程參與本課程,並完成與修課生同樣的義務(包含作業的繳交)
2.所有學生(包含旁聽生)需在2017/12/12課程開始前閱畢所有指定閱讀。課程預習從此開始!
