課程概述 |
本課程的目的在於引發學生從必較分析的觀點思考全球化對於法治 (rule of law) 在理論與實務的影響。本次上課聚焦在各種有關全球憲政主義 (global constitutionalism) 的學說討論。除第一次上課導論外，課程結構如下：第二次上課以「憲法化」(constitutionalization) 此一全球憲政主義理論的核心概念為分析焦點，第三次至第五次上課將集中討論歐盟作為全球憲政主義理論雛形及其運用所衍生的問題，第六次與第七次上課探討各種不依附政治秩序所提出的全球憲政主義觀點，第八次則反思全球憲政主義思考與內國憲政主義實踐的關係。 |
